DEMOCRATICALLY ELECTED VERSUS LEGALLY ELECTED AND IMPLICATIONS FOR DEMOCRATIC CONSOLIDATION IN NIGERIA
Not many will dispute the fact that Nigerian democracy is beleaguered and inundated by legal outcomes that have in many cases mitigated the chief tenet of democracy – majority rule. If democracy remains a system that rests on the collective will and choice of the majority and if the majority at elections have made a collective choice does it not amount to a subversion of the people’s will if the courts on technicalities legally declares another elected?
